Terms of Service

1. Acceptance of Terms

By becoming a member of Abatungi Barungi Farmers SACCO or using our services, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific services. If you do not agree to these terms, please do not use our services.

2. Membership Eligibility

Membership in Abatungi Barungi Farmers SACCO is open to:

  • Farmers, agribusiness operators, and agricultural workers
  • Business owners and entrepreneurs
  • Individuals aged 18 years and above
  • Persons of sound mind and good character
  • Groups, associations, and cooperatives (corporate membership)

All applicants must provide valid identification, complete the membership application process, and pay the required registration and share fees.

3. Member Obligations

As a member, you agree to:

  • Provide accurate and truthful information in all dealings with the SACCO
  • Maintain minimum savings as required by the SACCO policies
  • Repay any loans according to the agreed terms and schedules
  • Attend general meetings and participate in SACCO activities
  • Abide by the SACCO's bylaws, policies, and decisions of the Board
  • Notify the SACCO of any changes in your contact information or circumstances
  • Not engage in any activities that could harm the SACCO's reputation or interests

4. Savings Services

Our savings services are subject to the following terms:

  • Minimum opening balance and regular contribution requirements apply
  • Interest rates on savings are determined by the Board and may change
  • Withdrawals are subject to the SACCO's withdrawal policies and available funds
  • Shares cannot be withdrawn while a member has outstanding loans
  • Dormant accounts may be subject to maintenance fees

5. Loan Services

Loan services are provided under the following conditions:

  • Loan eligibility is based on membership duration, savings history, and creditworthiness
  • All loans require guarantors and/or collateral as specified in our loan policies
  • Interest rates and fees are disclosed at the time of loan application
  • Late payments may incur penalties and affect future loan eligibility
  • Default may result in recovery action including the sale of collateral
  • Guarantors are jointly liable for the loan in case of default

6. Market Linkage Services

Our market linkage services connect members with buyers and markets. While we facilitate these connections, we do not guarantee:

  • Specific prices or market outcomes
  • The performance of third-party buyers or sellers
  • The quality of products from other members

Members are responsible for their own transactions and should conduct due diligence on any parties they engage with through our market linkage services.

7. Termination of Membership

Membership may be terminated:

  • Voluntarily, by written notice to the SACCO (subject to clearing all obligations)
  • By the Board for violation of these terms, bylaws, or conduct detrimental to the SACCO
  • Upon death of the member (benefits transferred to designated beneficiaries)
  • Due to prolonged inactivity as defined in our policies

Upon termination, members are entitled to their savings and shares after deducting any outstanding obligations, subject to the SACCO's withdrawal procedures.

8. Limitation of Liability

Abatungi Barungi Farmers SACCO shall not be liable for:

  • Losses due to circumstances beyond our reasonable control (force majeure)
  • Investment losses or market fluctuations affecting member returns
  • Unauthorized access to member accounts due to member negligence
  • Actions of third parties connected through our services

9. Dispute Resolution

Any disputes arising from membership or use of services shall be resolved through:

  • Direct negotiation between the member and SACCO management
  • Mediation by the SACCO's supervisory committee
  • Arbitration under the Arbitration and Conciliation Act of Uganda
  • Courts of competent jurisdiction in Uganda as a last resort

10. Governing Law

These Terms of Service are governed by the laws of the Republic of Uganda, including the Cooperative Societies Act and regulations issued by the Uganda Microfinance Regulatory Authority (UMRA).

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to members through appropriate channels. Continued use of our services after such changes constitutes acceptance of the modified terms.
